{"id":587,"date":"2008-02-07T23:12:04","date_gmt":"2008-02-08T04:12:04","guid":{"rendered":"http:\/\/www.trustyetc.com\/trustyblog\/2008\/02\/08\/etech-and-copyright\/"},"modified":"2008-02-08T13:12:26","modified_gmt":"2008-02-08T18:12:26","slug":"etech-and-copyright","status":"publish","type":"post","link":"https:\/\/www.trustyetc.com\/trustyblog\/2008\/02\/07\/etech-and-copyright\/","title":{"rendered":"eTech and Copyright"},"content":{"rendered":"<p>Thanks to my good friend, <a target=\"_blank\" href=\"http:\/\/staff.bbhcsd.org\/schinkerj\/\">John<\/a>, for pointing out this text on page 11 of the eTech Ohio 2008 conference guide book.<\/p>\n<p><img decoding=\"async\" src=\"http:\/\/www.trustyetc.com\/trustyblog\/wp-content\/uploads\/2008\/02\/etechcopyright.png\" alt=\"etechcopyright.png\" \/><\/p>\n<p>Here we have another attempt at making copyright law more than it is.\u00a0 Copyright law in this country is defined by the <a target=\"_blank\" href=\"http:\/\/www.copyright.gov\/\">United States<\/a> government and there are clear limitations on any copyright owner&#8217;s exclusive rights.\u00a0 It&#8217;s called <a target=\"_blank\" href=\"http:\/\/www.copyright.gov\/title17\/92chap1.html#107\">Fair Use<\/a>\u00a0and it not only applies to &#8220;purely educational&#8221; use, but also:<\/p>\n<blockquote><p>for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research<\/p><\/blockquote>\n<p>So I may use an except of a copyright protected work without permission\u00a0(as I have with the electronically scanned insert above) to make comments (as I am now) about that copyright protected work.<\/p>\n<p>A copyright owner cannot redefine copyright law by\u00a0stating extra limitations in a book, audio or video recording.\u00a0 Here is a great story chronicling the efforts of the <a target=\"_blank\" href=\"http:\/\/arstechnica.com\/news.ars\/post\/20070320-nfl-fumbles-dmca-takedown-battle-could-face-sanctions.html\">NFL to takedown a video posted by Wendy Seltzer<\/a>.\u00a0 Wendy recorded the disclaimer by the NFL where they state:<\/p>\n<blockquote><p>This telecast is copyrighted by the NFL for the private use of our audience, and any other use of this telecast or of any pictures, descriptions or accounts of the game without the NFL&#8217;s consent is prohibited<\/p><\/blockquote>\n<p>Wendy then posted the video on <a target=\"_blank\" href=\"http:\/\/www.youtube.com\/watch?v=a4uC2H10uIo\">YouTube<\/a> so she could have a discussion with her online class (fair use &#8211; teaching).\u00a0 The NFL tried to have the video taken offline, but failed to do so.<\/p>\n<p>More than anything else, I wish the copyright notice\u00a0in eTech&#8217;s material could promote something like <a target=\"_blank\" href=\"http:\/\/creativecommons.org\">CreativeCommons<\/a>.\u00a0 This would make it much easier for educators to use the work without worrying about breaking the law (I am uncertain of the exact\u00a0meaning of &#8220;purely educational purposes&#8221;) and commercial use could be restricted with a <a target=\"_blank\" href=\"http:\/\/creativecommons.org\/licenses\/by-nc\/1.0\/\">CC-noncommercial license<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Thanks to my good friend, John, for pointing out this text on page 11 of the eTech Ohio 2008 conference guide book.
